ENCOURAGING THE HUMANISTIC VALUES OF THE LAW FOR SENIOR CITIZENS

The Center for Rural Development – Saemaul Undong (CRD-SU), University of Social Sciences and Humanities – Vietnam National University Ho Chi Minh City (USSH – VNUHCM) built up a project named: “Truyền thống “Già cậy con” và Luật Người Cao tuổi: Rào cản và khuyến nghị tư pháp qua nghiên cứu thực trạng thực hiện Luật Người Cao tuổi tại tỉnh Đồng Tháp” (The tradition “The older’s dependence on their children” and the Law for Senior Citizens: Barriers and Recommendations to the Justice system through the execution of this Law in Dong Thap Province). This project was funded by JIFF Foundation and OXFAM Organization in Vietnam.
 
The project focused on the factors or the barriers in the enforcement of the Law for Senior Citizens, hence, provided recommendations to the Justice system and implemented the Law in our real life. On December, 29th 2020, the Center organized the final report of the project with many participants coming from the Senior Citizens Association in Ho Chi Minh city and related provinces in the project. Representatives of the Center for Vietnamese and Southeast Asian Studies, Dr. Tran Dinh Lam – Director attended in the report.
 
In Vietnam, the elder had the “right” to be taken care of by their offspring as well as their children’s “obligation” was officially recognized by ethical standards and traditional customs. The Law for Senior Citizens was permitted by National Assembly on  November, 23rd 2009, which specifies rights and obligations of the elder, responsibilities of family, government, and society in supporting, caring and promoting the elder’s role.    
 
In the report, Dr. Pham Thanh Duy - Vice Director of the CRD-SU, Coordinator of the project, informed the result and provided some recommendations to the Justice system after conducting the research in Dong Thap province. Accordingly, the elder people living in the urban areas had an educational level as well as living conditions better than those living in rural areas. Their highest expectations are health care, welfare security, and ensuring food. At the same time, the research figured out the inequality in the dissemination of laws for the underprivileged in society. The main reason caused by the older barrier: level of education, health, aging; or outside barriers were dissemination in information, the attraction of the Law for Senior Citizens,...

Therefore, the research team provided recommendations to the Justice system in order to make the Law for Senior Citizens coming into real life. Dr. Duy stressed the dissemination of the information’s role. These actions need to be not only conducted in the Senior Citizens association but also invested to popularize in many means of public communication. Besides, the research team recommended reducing the age receiving welfare security from 80 to 75 in order to suit with longevity construction of Vietnamese people nowadays (73 years old).
 
One of the successful results of the CRD-SU was to host the training conference to enhance the awareness of local people in Dong Thap province about this Law. The online conference attracted more than 2500 people in 25 positions from 12 districts on December 26th, 2020. The training conference brought out many positive effects, it had a practical meaning to elder people in Dong Thap province. Moreover, the Law for Senior Citizens has the humanistic value towards ensuring the benefits and upgrading the obligations, responsibilities of the elder. In the future, people need to popularize and promote the Law continuously by focusing on solving the barrier elements. Therefore, the Law will be more and more easily put in practical life.
